1. Acceptance of Terms
By accessing or using Your Personal Stories (“YPS,” “we,” “our,” or “us”), including our website, applications, and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
YPS provides a digital platform for recording, preserving, and sharing personal life stories through video recordings, photo albums, family trees, AI-generated biographies, QR memorial codes, and related features. The Service includes free and paid subscription tiers with varying feature sets and storage limits.
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your information up to date. You must be at least 13 years old to create an account. Users between 13 and 18 require parental or guardian consent.
4. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
5. Intellectual Property
You retain ownership of all content you upload to the Service, including videos, photos, text, and other materials (“User Content”). By uploading User Content, you grant YPS a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your content solely for the purpose of providing the Service. The YPS platform, including its design, code, features, and branding, is owned by YPS and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without prior written consent.
6. Limitation of Liability
To the maximum extent permitted by law, YPS and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
7. Termination
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. We will retain your User Content for a reasonable period to allow you to export your data, after which it may be permanently deleted.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
